The federal rule
The 2018 Farm Bill removed hemp from the federal controlled-substances definition, defining hemp as cannabis containing no more than 0.3% delta-9 THC by dry weight. At or below that line it is an agricultural commodity that ships legally. Above it, it is marijuana.

Why THCa flower qualifies
Fresh flower is mostly THCa, not delta-9 — so it tests comfortably under the limit while carrying 20%+ THCa that converts when heated. That is the mechanism behind the entire legal hemp flower market, and it is not a loophole so much as a consequence of which molecule the rule names: what THCa turns into when heated.
Where states diverge
Federal law is a floor, not a ceiling. States regulate on top of it, and the picture is genuinely uneven:
Permissive: most states follow the federal definition directly.
Restricted: some cap potency, limit product types, or require specific labelling and age gates.
Banned: a handful prohibit hemp-derived THC products outright.
Total-THC states: some measure THCa plus delta-9 combined, which changes what qualifies entirely.
